Service Terms
All services and products are provided on a first-come, first-served basis, except for homeless, elderly, and veteran participants who may receive priority. Products and services are accepted "as is," and users are responsible for inspecting items before use.

You agree not to reproduce, redistribute, sell, or barter any intellectual property, services, or products provided by RESCUES ON85TH. By using our services, you grant us a royalty-free license to display, use, and publish any images or content you upload or provide, including photos taken at distribution events.

User Accounts 
If you register for an account, you are responsible for ensuring the accuracy of the information provided and safeguarding your login credentials. You must notify us immediately if you suspect any unauthorized access to your account. We reserve the right to terminate accounts, modify content, or cancel orders at our discretion.

Eligibility Requirements 
1. Only one account per household, regardless of the number of cats or dogs (FAMs) in residence.
2. Applicants must be the legal owner of the FAMs listed in their application.
3. Valid Alabama state identification or a referral letter from a social service agency is required.
4. Products provided through our programs may not be sold, traded, or distributed to others.
5. Using multiple identities to apply for services is prohibited and will result in immediate disqualification.
6. Applications must be fully completed to be eligible for product distribution.
7. Participants must provide additional income verification, such as WIC, Medicaid, or an unemployment document.
8. After three distributions, proof of spaying or neutering of the FAMs must be provided to continue receiving assistance.
9. Breeders are not eligible for services.
10. Violent behavior towards staff or volunteers will result in an immediate and permanent ban, and law enforcement will be notified if necessary.
11. Staff, volunteers, and partner agencies are not eligible to receive services or products through RESCUES ON85TH programs.

 

Indemnification 
You agree to indemnify and hold RESCUES ON85TH harmless from any legal claims arising from your use of our services, website, or social media. We reserve the right to choose our legal representation.

Limitation of Liability  
RESCUES ON85TH is not responsible for any damages arising from your use or misuse of our Website or services. We reserve the right to modify these Terms at any time, and you will be notified via email of any changes. Continued use of our services implies acceptance of the updated Terms.

Waiver of Liability  
By engaging with our services, you agree to the Assumption of Risk, Release, Hold Harmless, and Waiver of Liability. You also acknowledge that products may be donated or returned items and accept them on an “as is” basis. Any risks related to their condition or use are assumed by you, and you waive any claims of liability against RESCUES ON85TH.
